The report finds that Member States have established solid legal frameworks and safeguards that are broadly aligned with EU and international standards.
Core procedural safeguards are widely recognised across Member States, including reasoned judicial decisions, periodic review of pre-trial detention, the right to be heard, access to legal assistance and available remedies. Minimum standards on detention conditions are also largely in place, covering areas such as healthcare, hygiene, nutrition, outdoor exercise, family contact and complaint mechanisms.
The report also identifies a number of best practices implemented across the EU that can help Member States further strengthen implementation. This includes the expanded use of non-custodial measures, specialised support for vulnerable detainees, strengthened prison monitoring systems and innovative approaches to rehabilitation and reintegration.
While detention is a national competence, the Commission will continue to support Member States in implementing the Recommendation, including by disseminating guidance, and supporting training and exchanges of good practice between Member States.
